The House of Representatives is slated to begin debate on passage of their fiscal year 2009 budget the week of April 28th. After passage of the bill, the Senate will digest the House's action and develop their own budget recommendations.

Faced with a revenue shortfall, the House Ways and Means Committee released a $27.99 billion budget for fiscal 2009 that trimmed $109 million from the previous year's budget. The measure, which, incorporated $381 million from increased corporate tax collections and a $1-per-pack cigarette tax, draws $427 million from the state's $2.2 billion reserve account.

The Massachusetts House of Representatives recently passed a bill to raise the state's cigarette tax $1 per pack and to revise certain corporate tax laws to enhance state collections. In response to Governor Deval Patrick's repeated calls for alternative funding solutions from the Legislature, House Speaker Sal DiMasi introduced the cigarette tax while also developing corporate tax code changes including a general corporate excise rate cut.

Faced with the potential loss of federal funds and missed opportunities for the Spring construction season, the Massachusetts Legislature passed a $3.5 billion transportation bond bill during the week of April 10th. While the House sought to pass legislation that merely qualified the Commonwealth for matching federal funds, the Senate signaled its intent to include a number of transportation reforms.

Legislation that requires business owners to pay three times the wages owed to an employee in the event the employee is successful for suing for the unpaid wages became law without the Governor's signature on April 14th. The new law, Chapter 80 of the Acts of 2008, was hotly contested by business organizations, who opposed the measure, and organized labor, who supported it.
